MCoal Joins ADEM in Defending its Issuance of the Rosa Mine NPDES Permit

MCoal’s proposed mining activities at the Rosa Mine will not be delayed by the Petition, as the filing of the Petition does not impact the current validity of the Permit under AEMC’s regulations. No schedule has been set for the hearing, but similar matters have taken several months to be heard and may take up to a year or more to be finally concluded.
Neil MacDonald, President & CEO of Novadx and CEO of MCoal commented, “by filing this motion, we seek to join ADEM in defending its issuance of the Permit to MCoal for the Rosa Mine. This action by the environmental groups is without merit, and we are going to use all means available to us to assist ADEM in its defense and in obtaining the ultimate dismissal of this Petition. The Permit was issued to MCoal for the Rosa Mine following several months of diligent review by ADEM of our mine plans and water quality data. We have met or exceeded all legal and environmental requirements pertaining to issuance of the Permit and are confident that this Petition, when heard by AEMC, will be dismissed. We will continue to implement our plans to be in production at Rosa Mine in the first quarter of next year.”
Mr. MacDonald further commented, “at the Rosa Mine we will be auger mining an unreclaimed highwall left by previous surface mining operations in the 1960’s and early 1970’s. The auger mining method enters the coal seam horizontally from the existing highwall with minimal additional excavation thereby dramatically reducing the amount of surface disturbance as compared to other mining methods. During mining and after reclamation of the Rosa Mine, the negative environmental effect of uncontrolled surface discharges from the existing old mine workings at the Rosa Mine site will be reduced. Beyond the positive economic impact our project will have on the local community, reducing the existing uncontrolled surface discharges from the existing mine workings will have a very positive impact on the
